Pommmo is licensed to You (“End-User”) by Pommmo (“Licensor”), for use only under the terms of this License Agreement.

By downloading the Licensed Application from Apple's App Store or Google’s Play Store, and any update thereto (as permitted by this Licence Agreement), You indicate that You agree to be bound by all of the terms and conditions of this Licence Agreement, and that You accept this Licence Agreement. App Store and Play Store are referred to in this Licence Agreement as “Services”.

The parties of this Licence Agreement acknowledge that the Services are not a Party to this Licence Agreement and are not bound by any provisions or obligations with regard to the Licensed Application, such as warranty, liability, maintenance and support thereof. Pommmo, not the Services, is solely responsible for the Licensed Application and its content.

This Licence Agreement may not provide for usage rules for the Licensed Application that are in conflict with the latest Apple Media Services Terms and Conditions and Google Play Terms of Service (“Usage Rules”). Pommmo acknowledges that it has had the opportunity to review the Usage Rules and this Licence Agreement is not conflicting with them.

Pommmo, when downloaded through the Services, is licensed to You for use only under the terms of this Licence Agreement. The Licensor reserves all rights not expressly granted to You. Pommmo is to be used on devices that operate with Apple’s operating system (“iOS”) or Google’s operating system (“Android”).

1. THE APPLICATION

Pommmo (“Licensed Application”) is a piece of software created to help users manage time more effectively through the Pomodoro technique. It is designed for iOS and Android mobile devices (“Devices”). The app allows users to run timed focus sessions, track their productivity, and view anonymised usage statistics.

The Licensed Application is not tailored to comply with industry-specific regulations (like the Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subject to such laws, you may not use this Licensed Application.

2. SCOPE OF LICENCE

2.1 You are given a non-transferable, non-exclusive, non-sublicensable licence to install and use the Licensed Application on any Devices that You (End-User) own or control and as permitted by the Usage Rules.

​

2.2 This licence also governs any updates of the Licensed Application provided by Licensor, unless a separate licence is provided for such update.

​

2.3 You may not share, sell, rent, lend, lease, or otherwise redistribute the Licensed Application (except as allowed by the Usage Rules).

​

2.4 You may not reverse engineer, translate, disassemble, decompile, or attempt to derive the source code of the Licensed Application, or any part thereof.

​

2.5 You may make and store copies only on devices that You own or control for backup purposes under the terms of this licence, the Usage Rules, and applicable laws.

​

2.6 Violations of these obligations, as well as attempts thereof, may be subject to prosecution and damages.

​

2.7 Licensor reserves the right to modify the terms and conditions of licensing.

​

2.8 Nothing in this licence restricts third-party terms. You must comply with applicable third-party terms and conditions when using the Licensed Application.

3. TECHNICAL REQUIREMENTS

3.1 The Licensed Application requires iOS 12, Android 10, or higher. Licensor recommends using the latest version.

​

3.2 Licensor attempts to keep the Licensed Application updated, but you are not guaranteed rights to future updates.

​

3.3 You acknowledge it is your responsibility to ensure your Device meets technical specifications.

​

3.4 Licensor reserves the right to modify technical requirements at any time.

4. NO MAINTENANCE OR SUPPORT

4.1 Pommmo is not obligated, expressed or implied, to provide maintenance, technical, or other support for the Licensed Application.

4.2 The Services have no obligation to provide maintenance or support for the Licensed Application.

​5. INTELLECTUAL PROPERTY

​

5.1 All text, content, graphics, user interfaces, trademarks, logos, sounds, artwork, and other intellectual property appearing in Pommmo (collectively “Our Content”) are owned, controlled, or licensed by the Licensor and are protected by intellectual property law.

5.2 Pommmo grants you a limited, personal, non-transferable, revocable licence to access and use Our Content, under the following conditions:

• You may not use, sell, modify, or distribute Our Content except as permitted by the functionality of the App.

• You may not use our name in metatags, keywords, or hidden text.

• You may not create derivative works, scrape, decompile, or commercially exploit Our Content.

• You may use Our Content for lawful purposes only.

5.3 The Licensed Application does not offer users the ability to post or submit content.

​

6. LIABILITY

Licensor takes no accountability or responsibility for damages caused by violations of this Licence Agreement. You are responsible for making backups where applicable. Alterations or manipulations of the Licensed Application may result in loss of access.

7. PRIVACY

For information about how Pommmo collects, uses, and processes data, please see our Privacy Policy. By using Pommmo, you agree that we may process anonymised usage and crash data in accordance with our Privacy Policy.

8. WARRANTY

8.1 The Licensed Application and Our Content are provided “as is” and “as available,” without warranties of any kind.

8.2 Where applicable law does not permit exclusions, we grant the minimum warranty required by law.

​

8.3 We do not guarantee that Our Content will be uninterrupted, secure, error-free, or meet your expectations. Use of the app is at your own risk.

9. LEGAL COMPLIANCE

​

You represent and warrant that You are not located in a country subject to a US Government embargo, designated as “terrorist supporting,” or listed on any US Government list of prohibited parties.

11. TERMINATION

​​

The licence is valid until terminated by Pommmo or by You. Rights will terminate automatically without notice if You fail to comply with this Licence Agreement. Upon termination, You must stop using the Licensed Application and delete all copies.

12. THIRD-PARTY TERMS AND BENEFICIARY

​

Pommmo will comply with applicable third-party terms when using the Licensed Application. Both Apple and Google (and their subsidiaries) are third-party beneficiaries of this Licence Agreement, and may enforce it against You.

13. INTELLECTUAL PROPERTY RIGHTS

​​

In the event of a third-party claim regarding intellectual property infringement arising from the Licensed Application or its use, Pommmo (not the Services) will be solely responsible for handling such claims.

14. APPLICABLE LAW

​​

This Licence Agreement is governed by the laws of the United Kingdom.

​

15. MISCELLANEOUS

​

15.1 If any terms are invalid, the validity of the remaining provisions shall not be affected. Invalid terms will be replaced by valid ones achieving the same purpose.

15.2 We may amend this Licence Agreement at any time. Changes will be reflected on this page, with an updated effective date. Your continued use of Pommmo constitutes acceptance of the updated Licence Agreement.
